Terms of Service

1. Acceptance of Terms

By downloading, installing, or using EQ Studio (the "Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the Software.

These Terms constitute a legal agreement between you ("User" or "you") and Dmytro Kolyvai ("Developer", "we", "us", or "our"), the developer of EQ Studio.

2. Software License

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install EQ Studio on macOS devices you own or control
• Use the Software for personal, educational, or commercial purposes
• Process your own audio and video files using the Software

License Restrictions

This license does NOT permit you to:

• Distribute, sell, rent, lease, or sublicense the Software
• Use the Software on devices you do not own or control (without proper licensing)
• Remove or modify any copyright, trademark, or other proprietary notices
• Use the Software for any unlawful purposes

App Store License

If you obtained EQ Studio through the Mac App Store, your use is also governed by Apple's Licensed Application End User License Agreement (LAEULA). In case of conflict, Apple's terms take precedence for App Store-related matters.

3. Permitted Use

Copyright Compliance

You are solely responsible for ensuring you have the necessary rights to process any audio or video content using EQ Studio. This includes:

• Owning the copyright to the content
• Having proper licenses for copyrighted material
• Complying with fair use provisions where applicable
• Respecting the rights of content creators and copyright holders

4. Restrictions

Technical Restrictions

You may not:

• Reverse Engineer: Decompile, disassemble, or reverse engineer the Software
• Modify: Modify, adapt, or create derivative works of the Software
• Remove Protection: Bypass, remove, or disable any security features or copy protection
• Extract Components: Extract or isolate any part of the Software for separate use

Distribution Restrictions

You may not:

• Distribute copies of the Software to third parties
• Make the Software available over a network where multiple users can access it
• Rent, lease, lend, or sublicense the Software
• Bundle the Software with other applications without permission

System Requirements

The Software is designed for macOS 13.5 or later. Using the Software on unsupported systems may result in:

• Reduced functionality or performance
• Unexpected behavior or crashes
• No technical support from the Developer

5. Intellectual Property

Ownership

EQ Studio and all intellectual property rights therein are and remain the exclusive property of Dmytro Kolyvai. This includes:

• Source code, object code, and executable files
• User interface design and graphics
• Audio processing algorithms and implementations
• Documentation, help files, and user guides
• Trademarks, logos, and branding elements

Third-Party Components

EQ Studio uses the following third-party frameworks and components:

User Content

You retain all rights to the audio and video content you process using EQ Studio. We do not claim any ownership over your content or the output files created by the Software.

6. Disclaimers

"As Is" Basis

EQ Studio is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the Software will be uninterrupted or error-free
• Warranties that the Software will meet your specific requirements
• Warranties regarding the accuracy or reliability of any output

No Warranty of Results

We do not warrant that:

• The Software will produce specific audio quality improvements
• Processed files will be suitable for any particular purpose
• The Software will be compatible with all audio/video formats
• Use of the Software will not result in data loss

Beta and Pre-Release Software

If you are using a beta or pre-release version of EQ Studio, additional disclaimers apply:

• The software may contain bugs or incomplete features
• Data loss or corruption may occur
• Performance may be suboptimal
• No technical support is guaranteed for pre-release versions

7. Limitation of Liability

Excluded Damages

To the fullest extent permitted by applicable law, we shall not be liable for:

• Indirect Damages: Lost profits, lost revenue, lost business opportunities
• Consequential Damages: Business interruption, lost data, system downtime
• Incidental Damages: Cost of substitute products or services
• Punitive Damages: Even if we were advised of the possibility of such damages

Data Loss

We are not responsible for:

• Loss or corruption of your original audio/video files
• Loss of processed or exported files
• Loss of custom presets or settings
• Any costs associated with data recovery services

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

8. Governing Law

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising out of or relating to these Terms or the Software shall be subject to the exclusive jurisdiction of the courts of Poland.

EU Users

If you are a consumer in the European Union, you may have additional rights under EU consumer protection laws that cannot be limited by these Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Software and supersede all prior or contemporaneous communications and proposals.

• Significant changes will be announced via our website
• Continued use after changes constitutes acceptance of new Terms
